Three Employees of the Bandar Lampung District Prosecutor's Office Undergo the First Session on Performance Allowance Corruption

Kupastuntas.co, Bandar Lampung - Three employees of the Bandar Lampung District Prosecutor's Office underwent their first trial regarding the performance allowance corruption case at the Tanjung Karang District Court. Tuesday, 23 May 2023.

The three defendants are being tried with the agenda of reading out the indictments. The three are, Bery Yudanto (Finance and Personnel Head), Len Aini (Expenditure Treasurer), and Sari Hastiati (payroll operator).

In his indictment, Public Prosecutor Budi Mulia said the three defendants had misappropriated performance allowance money at the Bandar Lampung Prosecutor's Office from 2021 to 2022.

"That, between 2021 and 2022, the three defendants unlawfully committed an Employee Performance Allowance Deviation at the Bandar Lampung District Attorney's Office for 2021 to 2022 and used it for personal or other people's interests," said the Public Prosecutor, reading out the indictment.

The public prosecutor revealed that in January 2021, the defendant Sari Hastiati, at the request of Bery Yudanto and Len Aini, increased the grade of the amount of employee performance benefits that would be withdrawn from payroll.

Where, it was done by Sari Hastati making a letter to the destination bank, namely Bank BNI Tanjung Karang Branch, Bank Mandiri Cut Mutia Branch and Bank BRI Tanjung Karang Branch.

The letter contains a request for a performance allowance to be cut into Len Aini's account.

Then, a letter requesting the deduction of the money transfer to Bank BNI, Bank BRI and Bank Mandiri was submitted to Bery Yudanto to be signed on behalf of the Head of the Bandar Lampung District Prosecutor's Office without the knowledge and approval of the person concerned.

The public prosecutor revealed that as a result of the actions of the three defendants, the state suffered a loss of IDR 4,124,352,470.

The three defendants were subject to criminal sanctions under Article 3 in conjunction with Article 18 Paragraph (1) of RI Law Number 31 of 1999 concerning the Eradication of Corruption as amended by RI Law Number 20 of 2001 concerning Amendments to RI Law Number 31 of 1999 concerning Eradication of Corruption Jo Article 55 Paragraph (1) 1st Criminal Code Jo Article 64 Paragraph (1) 1st Criminal Code.

Meanwhile, the legal team for the three defendants agreed not to file an exception or defense.

Then, the trial will resume on Tuesday, 30 May 2023 with an agenda of evidence, the prosecutor will also present 10 witnesses. (*)
