Sahriwansah Returns 2.69 Billion State Losses, Legal Process Continues

Kupastuntas.co, Bandar Lampung - Sahriwansah, the suspect in the alleged corruption case regarding garbage retribution at the Bandar Lampung Environment Service (DLH) for 2019-2021, returned state losses of IDR 2.69 billion through Lampung High Court investigators.

This was stated by the Assistant for Special Crimes at the Lampung High Court (Kejati), Hutamrin.

"We received deposit of money from the suspect Sahriwansah in the amount of IDR 2.69 billion. This is money entrusted with state losses. The amount of the refund for state losses will be decided in court later," said Hutamrin, Monday (27/3/23).

He revealed that the Attorney General's Office in Lampung had previously received entrusted state losses from the assistant treasurer for Hayati recipients of IDR 108 million and IDR 478 million from other Technical Implementation Units.

"So far the total deposit of state losses has amounted to IDR3.28 billion. So there is still more than IDR3 billion left. Hopefully there will be good will from the others," said Hutamrin.

Hutamrin emphasized that even though the state losses had been returned, the legal process was still ongoing. Returning state losses can be a consideration to relieve the suspects in court later.

The three suspects in the waste retribution corruption case at DLH Bandar Lampung for the 2019-2021 fiscal year are still receiving salaries as state civil servants (ASN) of 50 percent.

They are the former Head of DLH Bandar Lampung Sahriwansah, the former Head of Environmental Management of DLH Bandar Lampung Harris Fadillah, and the former assistant treasurer of DLH Bandar Lampung Hayati.

Head of the Bandar Lampung Regional Personnel Agency (BKD), Herliawati said, her party was still waiting for an arrest warrant from the Lampung Attorney General's Office to remove Harris Fadillah and Hayati's positions. However, both of them have been deactivated from their posts.

Meanwhile, Sahriwansah had already resigned from his position as Head of Social Services. "There is no official letter of detention from the Attorney General's Office addressed to the Mayor yet, so we are still waiting. Because that is our basis for removing positions," said Herliawati, Friday (24/3/23).

He said, against these two suspects only their positions were removed, while their ASN status was still attached to them.

So, he continued, even though they would later be dismissed from their positions after receiving an arrest warrant from the Attorney General's Office, they would still receive salaries including Sahriwansah.

"Even though they have been detained they are still receiving their salary now, but they are not receiving benefits and so on. After their resignation they were arrested and dismissed as civil servants, they did not receive any salary anymore," he said.

Herliawati explained that the salary currently received by the three suspects is only 50 percent. "The salary that will be received will be 50 percent," he said.

Previously it was reported, the Lampung Attorney General's Office had named three suspects in the corruption case of the Bandar Lampung DLH garbage fee for the 2019-2021 fiscal year.

The three suspects are Sahriwansah as Head of Department of DLH Bandar Lampung for the 2019-2021 year, Harris Fadillah as Head of Environmental Management of DLH Bandar Lampung, and Hayati as assistant treasurer of Bandar Lampung DLH recipient.

Aspidsus Kejati Lampung, Hutamrin explained the modus operandi of the three suspects was by making a mark-up and not depositing the Bandar Lampung DLH garbage levy and there were also indications of fake garbage retribution tickets.

"The results of independent auditors have found a state loss of IDR 6,925,815,000," he explained.

The three suspects are charged with Article 2 paragraph (1) in conjunction with Article 18 of Law Number 31 of 1999 as amended by Law Number 20 of 2001 concerning amendments to Law Number 31 of 1999 concerning Eradication of Corruption Crime in conjunction with Article 55 Paragraph (1) 1st of the Criminal Code jo Article 64 paragraph (1) of the Criminal Code subsidiary Article 3 in conjunction with Article 18 of Law Number 31 of 1999 as amended by Law Number 20 of 2001 concerning amendments to Law Number 31 of 1999 concerning the Eradication of Corruption Crimes in conjunction with Article 55 Paragraph (1) 1st of the Criminal Code in conjunction with Article 64 paragraph (1) of the Criminal Code.
