Breakwater Projects in Canti South Lampung Allegedly Receive Stone Supply from Illegal Miners

Kupastuntas.co, Bandar Lampung - A contractor company for the construction of a beach safety (Breakwater) project in Canti Village, Rajabasa District, South Lampung worth IDR 34 billion, and IDR 53 billion in Banding Village, is suspected of receiving supplies of stone raw materials from illegal miners. In fact, according to regulations, raw materials must be supplied by licensed or legal mining companies.

The two break water projects belong to the Mesuji Sekampung River Basin Center (BBWSMS) for the 2023 fiscal year. The break water project in Canti Village is being undertaken by Limited Liability Company (PT) Loeh, and in Banding Village is being worked out by Limited Liability Company (PT) Mina Fajar Abadi.

The source of Kupastuntas.co said that PT Hajar Nusantara Abadi (Hana) supplied the stone raw materials for the break water project in Canti Village, which allegedly did not yet have a Stone Mining Permit (SIPB) and was not registered with the Lampung Province Energy and Mineral Resources Agency (ESDM).

In fact, PT Hana also did not process the Environmental Management Permit (UKL) and Environmental Monitoring Permit (UPL) from the Environment Agency (DLH). In fact, the document is one of the requirements in applying for an environmental permit.

He said that there were also illegal stone miners supplying stones to the contractor for the breakwater project on behalf of CV Ajoya. Meanwhile, the owner of CV Ajoya has frozen or not extended his stone mining permit. However, it turns out that CV Ajoya is still being used by residents to supply rocks to breakwater contractors.

"I assure you that PT Hana and the illegal stone miners who supply raw stone materials to the breakwater contractors in Canti Village and Banding Village. In fact, according to the provisions of the breakwater contractor company, the Mesuji Sekampung River Basin Center must obtain stone supplies from an official or licensed mining company. This source revealed that PT Hana does not yet have a Stone Mining Permit (SIPB) for 2023. Meanwhile, the SIPB is only valid for one year, and must be renewed every year. In addition, SIPB can only be issued after the contractor company has obtained a work contract.

"SIPB is one of the conditions for a rock mining company to supply rock to a breakwater contractor. PT Hana has not extended its SIPB for 2023. So it cannot become a stone supplier for the break water project," he said.

What was even more surprising, he continued, was that local residents used the company name CV Ajoya to supply rocks to a breakwater contractor company. "Even though CV Ajoya's permits have been frozen or not extended. That's why we are surprised how come the Mesuji Sekampung River Basin Authority can allow the two contractors to work on the two break water projects," he said.

He hopes that related parties, including law enforcement officials, can investigate the break water project. So the contractor and the Mesuji Sekampung River Basin Center are not playing games.

“Breakwater contractors are not supposed to accept raw stone supplies from illegal mining companies or illegal miners. If this is allowed, of course it is strongly suspected that there is a game," he said.

The owner of PT Hana, Decky Eko Saputra, when confirmed, said that his andesite mining company had obtained a license in accordance with the Decree of the Minister of Investment/Head of the Investment Coordinating Board Number: 94/1/SIPB/PMDN/2022 regarding the approval of issuing certain types of rock mining permits for andesite commodity to PT Hajar Nusantara Abadi (Hana) dated 17 May 2022.

"If we get permission to take care of it directly at the Ministry of Investment, not here. This means that we have already registered it with Modi (Minerba One Data Indonesia) and it has been issued, and can be checked at Modi. The SIPB is there, God willing, we have fulfilled all the other requirements," said decky.

Decky revealed, the mine owned by PT Hana is located in Canti Village, Rajabasa District, covering an area of 11.3 hectares with an estimated 500,000 cubic of andesite stones equipped with a permit valid for 3 years from the date of issue on May 17, 2022.

"If we have a lot of stone stock, our permit is 11 hectares, it has only been mined for 2 hectares, meaning that to cover 2 companies it is safe and sufficient," he said.

Decky also denied allegations that his company took stone materials from local residents. "In my terms, no one takes it from outside (the mine) or on behalf of PT Hana, and never recommends it to anyone. Yes, it means that our mine is completely pure, which is located in the existing zone as it is now, the coordinates match. Yes, it means if there is there is no person acting on behalf of PT Hana, you may ask for a letter of recommendation from me or my messenger, there is none," said Decky.

Decky claims he has taken care of the stone mining permit according to the rules set by the government. "Yes, it means we are purely working in the same location get that permission. That can be checked, meaning we have never made a recommendation, why are we dealing with permits if we still want to take them out," he said.

Young Expert Policy Analyst for the Natural Resources Section of the Regional Secretariat of the South Lamsel Regency Government, Eddy Zulkarnain explained, the Central Government has officially delegated a number of authorities related to mining permits to the regions.

"This policy is based on Presidential Decree Number 55 of 2022 concerning the delegation of granting business permits in the mineral and coal mining sector which was signed on April 11, 2022," he said.

With this policy, continued Eddy, the regions, in this case the Provincial Government, again have the authority to issue mining business permits.

"After previously this authority was withdrawn to the Central Government through the revision of Law Number 3 of 2020 concerning amendments to Law Number 4 of 2009 concerning mineral and coal mining," he explained.

Head of Structuring and Capacity Building of the South Lamsel Environment Service (DLH), Ervan Kurniawan added, according to Presidential Decree No. 55 of 2022 it was stated that the authority to issue permits for non-metallic mineral and rock mining currently rests with the provincial government. "As far as I know, for mining permits, the district has no authority anymore," he added.
